General terms

These terms and conditions are intended to define the rights and obligations that bind Lea Private Collection, single proprietorship founded in 2014 in Toronto by Elodie Machon, and its customers. They apply to any person (hereinafter referred to as the Client) buying, renting or commissioning a work from the company. Note that Lea Private Collection reserves the right to modify these terms and conditions at any time.

 

By contracting with Lea Private Collection, the Client agrees to have read the terms and conditions and to comply with them.

Capacity to contract

The Client warrants that they are fully authorized to use the checkbook or bank account they use, and that it is not a checkbook used fraudulently or an usurped account.

Copyright and intellectual property

Elodie Machon declares having all copyrights, intellectual property, or rights of any other kind, to legally transfer content to the website www.leaprivatecollection.com. The content of this website is protected by the laws of intellectual property and copyright. Any unauthorized reproduction or distribution of the information on this website is prohibited.

All the works are unique pieces created by Elodie Machon. The acquisition of a work gives no right of representation, reproduction or distribution to its purchaser. Elodie Machon solely retains the right on her work and image. Any representation or reproduction, in whole or in part, without the consent of Lea Private Collection is illegal by any means. Any non-personal use or showcasing of Elodie Machon’s works will require a written consent from Lea Private Collection.

4

Price and payment

4.1 Price

 

The applicable prices are those displayed on the website www.leaprivatecollection.com on the date of the order and do not carry effect for the future. These prices can be modified at any time by Lea Private Collection. Prices are quoted in $ CA and do not include shipping fees. No additional taxes apply. In case shipping is requested by the customer, shipping fees (including a shipping insurance) applicable on the date of the order will be added to the price of the work.

4.2 Terms of payment

 

The Client can make a payment by check, cash or bank transfer to the account of the company. To get information for a wire transfer, please contact Lea Private Collection at the email address: contact@leaprivatecollection.com. No other method of payment is allowed. When paying by check or bank transfer, legal delivery shall run only from the date of receipt of payment by Lea Private Collection.

 

4.2.1 Purchase of a work from the Lea Private Collection gallery

 

The price for the purchase of a work from the online gallery is payable in whole in one payment at the time of purchase and is followed by the delivery of the work.

 

4.2.2 Commission of a work by Elodie Machon

 

A deposit representing 50% of the total amount of the commission agreed upon by the Client and Lea Private Collection is due upon signature of the contract between the two parties and is non-refundable. The remaining amount is due upon delivery of the finished work.

 

Lea Private Collection will work in good faith to create compositions that meet the Client’s expectations. However, if the Client is not satisfied with the work at the time of delivery, there is no obligation to buy.

Please note that any request for the modification of a work after its purchase may be accepted on a case-by-case basis at the artist's sole discretion.

 

4.2.3 Consultation by Elodie Machon

 

Consultation prior to a commission is free.

The consultation can be done via email, phone, skype, or by appointment at your home (Toronto only). Whether you have a precise idea in mind or just a few requirements, you can discuss your project with artist Elodie Machon who will design a unique composition based on your tastes and furnishing.

 

4.2.4. Rental of works from the Lea Private Collection gallery

 

The rental service operates as an art library, providing individuals, corporations and institutions the right to rent original works by Elodie Machon.

Commitment to a six-month subscription, renewable, is required for this service. The total amount required to subscribe to the Lea Private Collection gallery is $ CA 600, payable in whole upon signature, or at a monthly rate of $ CA 100. During the subscription period, there is a rental limit of two works per month. Only one work can be rented at a time. No additional taxes apply.

 

Our works are available within the limits of available stocks. Although our site is updated regularly, some works may be temporarily or permanently unavailable. Lea Private Collection’s responsibility is not held liable for breach of contract due to non-availability of works. To check the availability of works, please contact Lea Private Collection at the email address: contact@leaprivatecollection.com.

 

The maximum rental time for one work is 30 days, renewable within the limits of available stocks. A 7 day delay following the 30 day period will be granted to the Client to return the work, after which a $ CA 20 late charge fee will be charged for every outlier day.

 

Works will be delivered (Toronto only) upon request or picked up and returned at the Lea Private Collection studio in Toronto, ON, by the Client, by appointment only.

 

Lea Private Collection is not liable for any damage or deterioration of the work that might result from the use and/or transportation of the work between the moments of pick up and return of the work to the Lea Private Collection studio. Any damage or deterioration will be charged to the Client to the amount of the total purchase price of the work as stated on the lea Private Collection online gallery.

4.3 Certificate of authenticity

 

Lea Private Collection will issue a certificate of authenticity for each work upon delivery.

4.4 Reserve of ownership

 

Works remain the property of Lea Private Collection until full payment of the purchase price, in accordance with this clause.

Delivery

5.1 Delivery in person (Toronto only)

 

Lea Private Collection may, upon request, deliver the work purchased to the Client within the limits of Toronto, ON. This service is free. For deliveries in person to the Client in Toronto, ON, please contact Lea Private Collection at: contact@leaprivatecollection.com.

 

The delivery of the work to the Client constitutes a transfer of ownership and operates a transfer of risks from Lea Private Collection to the Client. Lea Private Collection is not liable for any damage or deterioration of the work that might result from the handling/transportation of the work after the delivery has occurred.

 

5.2 Delivery

 

5.2.1 Shipping

 

"Shipping companies" are defined as the following logistics services suppliers: Canada Post, Fedex and UPS.

Once full payment is received by Lea Private Collection, the work can be shipped to Canada or internationally, at the applicable rate of the shipping service chosen by the customer. Prices vary depending on the weight, dimensions, insurance type, delivery lead time and purchase price of the work.

 

5.2.2 Shipping costs

 

Shipping costs cover the cost of packing*  and postage which includes insurance on the purchase value of the work.

These fees are additional to the price of the work. Lea Private Collection will inform the Client of the amount of these fees prior to payment of the work.

For deliveries outside of Canada, any customs fees and local taxes are the responsibility of the Client.

 

*The works are packed with great care to avoid any damage during the transport.

 

5.2.3 Delivery time

 

Once full payment is received by Lea Private Collection, the company promises to ship the package to Canada Post within a reasonable time. Thereafter, delivery times are those of the forwarder and vary depending on delivery location. An estimated time of delivery will be provided for information purposes.

 

5.2.4 Responsibility

 

Works always travel at the risk of the client. Risk transfer for works purchased by the customer occurs upon delivery by Lea Private Collection to the shipping company. Lea Private Collection is relieved of all responsibility once the package is supported by the shipping company and cannot be held liable for any delay, loss or damage that would occur on the routing time.

Lea Private Collection will not be responsible for any breach of delivery due to reasons beyond its control including force majeure, disruption or strike of postal services and transport.

In the case of a delivery of a work that is obviously and visibly damaged, the Client has to refuse it at the time of delivery in order to enjoy the insurance offered by the shipping company. The Client must notify Lea Private Collection within 48 hours in order to apply for a refund.

Right to withdraw

Under the Consumer Protection Act (CPA), the customer has a period of ten days after the delivery of the work to exercise his right of withdrawal without giving any reason or pay a penalty. However, the initial shipping costs and postage for the return of the work (packaging, delivery and insurance) are the responsibility of the Client.

Where the right of withdrawal is exercised, Lea Private Collection is required to reimburse the Client the full amount of the price of the work as soon as possible and no later than fifteen days from the date of delivery of the work to Lea Private Collection.

The refund is done by means of payment chosen by Lea Private Collection. Please note that the works returned damaged will not be refunded.

Refund

Any request for refund after the purchase of a work that does not fall under the right of withdrawal will be refused.
